What is considered wear and tear in security deposit disputes?

Wear and Tear is considered items that are natural to use and premises of a rental dwelling. For example if there are scuff marks behind where a bed or couch was next to a wall and it left a black mark, that would be considered wear and tear. Other items include natural use of walkways on carpet over the course of time would wear down the carpet and thus be normal wear and tear. Most Judges would side with the tenant in these type of scenarios.

We always have problems with this during evictions. The tenants always think its wear and tear and the landlords always thing it is excessive damages. We find that if it ever gets to an eviction hearing then the Judge always sides with the tenant

I would say a few holes in the wall from domestic disputes would NOT be considered wear and tear.
